     Upon consideration of the petition for rehearing en banc of appellee/cross-
appellant, the response thereto, and the vote by a majority of the judges of the court in
regular active service in favor of the petition, it is

     ORDERED that the petition be granted.  These cases will be reheard by the court
sitting en banc on Wednesday, May 10, 2000 at 10 A.M.  The judgment filed herein on
December 28, 1999 is hereby  vacated.  It is

     FURTHER ORDERED that an order governing further proceedings shall issue
