Is Mediation in the Court of Appeals Binding?

Mediation is binding only in the sense that if the parties do reach agreement on the disposition of their appeal, they are bound by the agreement as they would be by any other contract. Agreements must be reduced to writing. The mediator does not function as a decision-maker and cannot impose any particular solution upon the parties.
